This Service Agreement (the "Agreement") is between St. Pete Dump Trailers (a DBA of Gibson Management LLC), referred to as "the Company", and the customer named on the booking, referred to as "the Customer". By completing a booking, by signing a printed copy of this Agreement at delivery, or by replying to confirm a booking, the Customer agrees to all of the terms below.
1. Service being provided
The Company provides a hauling, transport, and delivery service using its own dump trailer and tow vehicle. The Company delivers the trailer, the Customer loads it within the agreed window, and the Company hauls and disposes of the load, or delivers material as ordered.
2. Service window
The service window depends on the package booked:
- Drop & Go: 1 Day — Drop-off between 7 AM and 10 AM, pickup by 7 PM the same day.
- Drop & Go: 2 Day — 2 days from drop-off.
- Drop & Go: 5 Day — 5 days from drop-off.
- Drop & Go: 7 Day — 7 days from drop-off.
Exact times are stated on the booking confirmation. For the 1-Day package, pickup is at 7 PM regardless of drop time. Special timing requests may be made at booking but are not guaranteed.
Additional days past the booked window are $50 per day per availability, billed automatically if the trailer is not ready at the scheduled pickup.
3. Maximum load weight
- Maximum cargo load: 10,000 lb (5 tons). The Customer agrees not to load the trailer beyond this limit regardless of how much volume space remains.
- An overloaded trailer will not be hauled. The Customer remains responsible for the full service fee plus a $250 overload reload fee and must remove material until the load is legal.
- Heavy materials (concrete, dirt, sand, asphalt, brick, tile, stone, gravel) must not exceed the marked fill line inside the trailer, approximately one-third of the wall height. A $100 heavy-material surcharge applies to these loads.
4. Prohibited items
The following are not accepted under any circumstances. The Customer is responsible for proper disposal of any of these:
- Hazardous materials of any kind (paint, solvents, chemicals, pesticides, fertilizers)
- Tires
- Refrigerators, freezers, and air conditioners (require certified freon evacuation)
- Batteries (auto, marine, lithium-ion)
- Asbestos or lead paint debris
- Liquid waste of any kind
- Propane tanks (full or empty)
- Electronics waste (TVs, computers, monitors)
- Medical or biohazardous waste
- Ammunition, fireworks, or explosives
5. Landfill and disposal fees
- On all Drop & Go packages, the Customer pays landfill fees at cost. The Company provides the weight ticket.
- Mid-rental Dump & Return (optional add-on): If the trailer is emptied and returned mid-rental so the Customer can continue loading, a $100 service fee plus $75 return fee applies, in addition to landfill tipping charges at cost.
6. Property and placement
- The Customer chooses and approves the trailer placement location at delivery.
- The empty trailer weighs roughly 4,800 lb and a loaded trailer can reach 14,800 lb.
- The Company is not responsible for damage to driveways, lawns, irrigation, sprinkler heads, pavers, septic systems, or other surfaces or structures caused by trailer placement, delivery, or pickup at a location the Customer approved.
- If the Customer is unsure whether a surface can take the weight, they should say so before delivery so a different spot can be chosen.
- The Customer is responsible for damage to the trailer beyond normal wear caused by the Customer's loading, contractors, or others acting at the Customer's direction. Damage beyond normal wear will be billed to the card on file at actual repair cost, documented with photos taken at pickup.
7. Safety
- No person may climb in or on the trailer at any time. All loading must be done from outside the trailer.
- Children and pets must be kept clear of the trailer at all times.
- The Customer is responsible for safe and lawful loading and for keeping the load within the trailer walls.
8. Payment
- The Customer authorizes a hold on their payment method at the time of booking.
- Final charges, including any surcharges, overage tonnage, extra days, or damage fees, are billed within 48 hours of pickup.
- Accepted payment: card via Stripe or Square. The deposit and card on file must be valid before drop-off.
9. Cancellation
- Cancellation more than 24 hours before scheduled delivery: no charge.
- Cancellation within 24 hours of scheduled delivery: 50% of the service fee.
- No-show or refused delivery on arrival: full service fee.
10. Equipment Transport (when applicable)
For equipment transport jobs, the Customer confirms the equipment make, model, and weight at booking. Equipment must be 8,000 lb or under. The equipment owner drives the equipment on and off the trailer where possible. The Company secures all loads with rated tie-downs. The Company may refuse any load that exceeds the trailer rating or cannot be safely secured.
11. Limitation of liability
The Company's total liability for any claim arising from the service is limited to the amount the Customer paid for that job. The Company is not liable for indirect or consequential damages.
The Company carries $1M / $2M commercial auto and general liability insurance. A certificate of insurance is available on request at [email protected].
12. Florida law
This Agreement is governed by the laws of the State of Florida. Any dispute arising from or related to this Agreement is handled in the courts of Pinellas County, Florida.
